What are the costs caps at the IPEC?



Exciting news for IP litigants in the UK! The costs caps at the Intellectual Property Enterprise Court (IPEC) will increase, following a decision by the Civil Procedure Rule Committee.


The overall costs cap for liability will increase from £50,000 to £60,000. The overall costs cap for quantum will go up from £25,000 to £30,000. The Committee also amended the stage caps, and said that the consistent application of VAT needed to be considered holistically.


The caps have not been changed since they were fixed in 2010. The new caps are likely to come into effect in October 2022.
